Fatal Rollover Accident and Wrongful Death Lawsuit Information
Rollover accidents account for nearly 33% of all deaths from passenger vehicle accidents. When someone dies in a rollover accident, that person’s family may have a wrongful death claim against other drivers, the manufacturer of the vehicle or any part thereof (the tires, for example), a bar or other seller of alcoholic beverages (dram shop laws), and/or the driver of the vehicle (if the one killed was a passenger).
Under most wrongful death statutes, the spouse and next of kin of the decedent can file a wrongful death lawsuit. The person who brings a wrongful death lawsuit is usually called a "trustee." He or she is appointed by a judge to bring the wrongful death claim on behalf of the family of the person who died. The wrongful death trustee is often one of the family members.
Each state has different laws about the type of losses obtainable in a rollover accident - wrongful death lawsuit:
- All states allow for the recovery of lost income the decedent would have provided his loved ones.
- Most states do not allow recovery for grief or anger suffered by the surviving heirs, but do allow money damages for the loss of advice, care, comfort and companionship the deceased would have provided had he or she lived.
- Some states also allow money damages for the pain and suffering of the deceased person prior to death.
