Toll House Lawsuit: Proving the Case

In order to win a Toll House lawsuit, we would have to prove the following three elements:

  1. The Nestle Toll House cookie dough was contaminated with E. coli bacteria. This can be done with empidemiological evidence (interviews, etc.) and/or microbiological evidence (genetic test results finding that the same strain of E. coli sickened the people who ate Nestle Toll House cookie dough). An FDA inspection of the Nestle Toll House cookie dough plant found equipment that was not able to be properly cleaned.
  2. The E. coli contamination caused illness.
  3. You suffered damage as a result of the E. coli contamination.

Our lawyers have handled numerous E. coli cases. We will use our knowledge of and experience with epidemiological and microbiological evidence to obtain full and fair compensation. Again, we have handled enough of these cases to know what a case is worth and not settle for less.
