Olive Garden Lawsuit: Restaurant Liability

Steak E. coliOlive Garden restaurants received steak that was later recalled by National Steak and Poultry due to possible E. coli O157:H7 contamination. The December 2009 steak recall was prompted by an E. coli outbreak linked to the recalled steak that sickened at least 21 people in California, Colorado, Florida, Hawaii, Iowa, Indiana, Kansas, Michigan, Minnesota, Nevada, Ohio, Oklahoma, South Dakota, Tennessee, Utah and Washington.

Olive Garden has a legal duty to serve food that is safe to eat. If your E. coli O157 infection can be linked to Olive Garden, you will have claims against both Olive Garden and the processor of the steak, National Steak and Poultry.

Under federal law, non-intact steak injected with brine is considered adulterated if it is contaminated with E. coli O157. This means that a strict liabilty claim is possible. With strict liability, the E. coli victim does not need to prove negligence on the part of the restaurant or processor.

Olive Garden has been associated with E. coli infections in the past. In the spring of 2005, an E. coli O157:H7 outbreak was associated with eating at an Olive Garden in Multnomah County, Oregon. According to the Multnomah County Health Department, no one food was strongly implicated in the outbreak that affected at least 18 people.  An Olive Garden lawsuit filed and quickly settled.

E. coli O157 can lead to hemolytic uremic syndrome (HUS), Thrombotic Thrombocytopenic Purpura (TTP) and death.
