Costco and Bravo Farms Lawsuit Filed by
E. coli Attorney on Behalf of Family
Pritzker Olsen law firm has filed a lawsuit through its local counsel on behalf of a family of four who contracted E. coli O157:H7 infections after consuming Bravo Farms Dutch Style Gouda Cheese at the Costco store located in Glendale, Arizona, on October 15, 2010. The lawsuit was filed in the U.S. District Court for the District of Arizona against Bravo Farms Cheese, LLC, a California limited liability corporation, and Costco Wholesale Corporation, a Washington corporation.
The Costco and Bravo Farms lawsuit alleges that the family suffered gastroenteritis, including severe cramping and diarrhea, from the Gouda cheese, which investigators have linked to an outbreak of E. coli O157:H7 that has sickened at least 33 people in Arizona, California, Colorado, Nevada and New Mexico.

Claims for Relief
The Costco and Bravo Farms lawsuit seeks relief for our clients under the following:
- Strict Liability. Defendant Bravo Farms had a duty to produce food products that are reasonably safe and fit for human consumption. Defendant Bravo Farms breached this duty because it manufactured, distributed, marketed and sold Bravo Farms Dutch Style Gouda Cheese contaminated with E. coli O157:H7, rendering it defective and unreasonably dangerous. Defendant Costco owed a duty to the plaintiffs to sell and make available to the public a food product that was not defective and that was reasonably safe. Defendant Costco breached this duty by selling, marketing and providing Bravo Farms Dutch Style Gouda Cheese contaminated with E. coli O157:H7, rendering it defective and unreasonably dangerous.
- Breach of Warranties. The Gouda cheese manufactured and sold by Bravo Farms was contaminated with E. coli O157:H7 bacteria, and was not fit for its normal and expected purposes of, human consumption. The Gouda cheese served and sold by Costco was contaminated with E. coli O157:H7 bacteria and was therefore not in a condition normally acceptable in the trade, and was thus in breach of the implied warranty of merchantability.
- Negligence and Negligence Per Se. Bravo Farms and Costco were negligent in manufacturing, distributing and selling a product that was not reasonably safe because adequate warnings or instructions were not provided, including, but not limited to, warnings that its products may contain E. coli O157:H7 bacteria and advising of the increased risks posed by unpasteurized dairy products. Defendants had a duty to comply with all state, local, and federal statutory and regulatory provisions that pertained and applied to the manufacture, distribution, storage and sale of its food products. This includes, but is not limited to 21 U.S.C. 331(a), the Federal Food, Drug and Cosmetics Act, that makes it unlawful to manufacture, sell or distribute food containing E. coli O157:H7. The defendants breached this duty and were negligent per se.
Costco and Bravo Farms Lawsuit: Compensation for
E. coli and HUS Victims
The Costco and Bravo Farms lawsuit seeks the following compensation for the family:
Damages for the loss of enjoyment of life, both past and future; medical and medical related expenses, both past and future; travel and travel-related expenses, both past and future; emotional distress and future emotional distress, pharmaceutical expenses, both past and future; wage loss, and other ordinary, incidental and consequential damages as would be anticipated to arise under the circumstances.
