Civil Case against a Drunk Driver?

Under DUI law in Minnesota, it is a crime to do to drive, operate, or be in control of any motor vehicle anywhere in the state while:

  1. Having an alcohol concentration of .08 (.08 means .08 percent alcohol concentration, which is 8/10,000ths by volume) or more at the time or within two hours of doing so;
  2. Having any amount or the metabolites of a schedule I or II controlled substance, other than marijuana, in the body; or
  3. If the vehicle is a commercial vehicle, having an alcohol concentration of .04 or more at the time or within two hours of doing so.

The Minnesota dram shop law (Minnesota Statutes, Section 340.801, Subdivision 1) reads as follows:

A spouse, child, parent, guardian, employer, or other person injured in person, property, or means of support, or who incurs other pecuniary loss by an intoxicated person or by the intoxication of another person, has a right of action in the person’s own name for all damages sustained against a person who caused the intoxication of that person by illegally selling alcoholic beverages.

The dram shop laws were enacted because bars and restaurants should be held accountable for negligently serving an obviously drunk person alcohol. This is a particularly important law because drunk drivers often have no insurance or inadequate insurance.
