Minneapolis: Mail Carrier Bit by Dog

Since 2006, the city of Minneapolis has changed its ordinance governing dangerous or potentially dangerous dogs three times in an attempt to set tougher standards and requirements for owners. One of the new ordinances requires a short leash and muzzle when a dog is outside.

In spite of the new ordinances, there have been many dog bites and dog attacks this summer. In four separate incidents in Minneapolis, mail carriers were attacked by dogs in a three-week period. Three of the attacks met the criteria to be classified as serious dog bites. A serious dog bite, as defined by the City of Minneapolis, is when there is a laceration of at least an inch or multiple skin punctures.

According to Minnesota State Statute 347.22, when a dog bites and/or attacks someone, the owner of the dog or keeper is generally liable for any resulting injuries.

Minnesota Statute 347.22: Damages, Owner Liability: If a dog, without provocation, attacks or injures any person who is acting peaceably in any place where the person may lawfully be, the owner of the dog is liable in damages to the person so attacked or injured to the full amount of the injury sustained. The term "owner" includes any person harboring or keeping a dog but the owner shall be primarily liable. The term "dog" includes both male and female of the canine species.

Landlords may be held liable for dog attacks, too. Minnesota law requires that landlords be notified if a tenant's dog is declared dangerous, because a rental owner who knows about an aggressive dog becomes legally liable for it, according to Minneapolis Animal Care and Control.
