Lawsuit against DePuy Orthopaedics for Compensation

Your lawsuit against DePuy Orthopaedics for compensation relating to your hip revision surgery will involve damages from both:

  • Your initial hip replacement surgery that implanted the defective DePuy ASR XL Acetabular System and
  • The hip revision surgery

Our law firm hires medical experts to help us build a case for compensation for medical expenses (including expected future expenses), pain and suffering and emotional distress. If you were working at the time of the surgeries, we will also make a case for compensation for lost earnings.

Generally, revision surgery is more difficult than first-time hip replacement surgery, and the outcome is not as good. This needs to be taken into account when determining how much money you should seek from DePuy Orthopaedics.

In addition, research has shown that the longer you wait for revision surgery, the more pain you will experience:

There was no change in pain or function for those waiting less than 6 months for surgery. For patients waiting 6–12 months or more than 12 months for surgery, there were statistically significant increases in pain and function (F = 7.12, p = 0.01 and F = 4.61, p = 0.01, respectively). For the 12 patients waiting 6–12 months, pain scores increased by 2 points and function scores increased by 5 points. For the 9 patients waiting more than 12 months for surgery, pain scores increased by 2 points and function scores increased by 9 points, representing increased pain and poorer function.1

You have the right to seek compensation for pain and suffering, emotional distress, disability and other damages. Contact our attorneys.

What to Expect after Your Hip Revision Surgery

Immediately after your hip revision surgery, you will be allowed only limited movement. When you are in bed, pillows or a special device are usually used to brace the hip in the correct position. You may receive fluids through an intravenous tube to replace fluids lost during surgery. There also may be a tube located near the incision to drain fluid, and a type of tube called a catheter may be used to drain urine until you are able to use the bathroom. The doctor will prescribe medicine for pain or discomfort.

On the day after surgery or sometimes on the day of surgery, therapists will teach you exercises to improve recovery. A respiratory therapist may ask you to breathe deeply, cough, or blow into a simple device that measures lung capacity. These exercises reduce the collection of fluid in the lungs after surgery.

While you are still in the hospital, a physical therapist may teach you exercises such as contracting and relaxing certain muscles, which can strengthen the hip. The physical therapist also will teach you the proper techniques for simple activities of daily living, such as bending and sitting, to prevent injury to your new hip.

Recovery from Your Hip Revision Surgery

Usually, people spend about 3 to 5 days in the hospital after hip revision surgery. Full recovery from the surgery takes about 3 to 6 months. In some cases, there is not full recovery. Your compensation from DePuy should take this into account.

Our law firm has a national practice. When we handle out-of-state product liability cases in state or federal court, we retain the services of local counsel, who then move to have us admitted pro hac vice, meaning "for this particular occasion." We handle the case but have local counsel to assist us with any local issues. This allows us to handle cases all over the country.

Certain DePuy hip revision surgery lawsuits have been consolidated in multi-district litigation proceedings. This is like a DePuy class action lawsuit.
