Product Liability Statistics

The physical, financial and emotional cost of defective products is astronomical. Each year hundreds of thousands of people are injured or killed by dangerous products ranging from toys, household equipment, cars and industrial products. For example, according to the Consumer Product Safety Commission in 2002 there were an estimated 212,000 emergency room visits for toys alone.

A product liability lawsuit involves injury caused by a defective product. A defective product is one that is not reasonably safe for its intended use. An intended use of a product includes all those uses a reasonably prudent person might make of the product, bearing in mind its characteristics, warnings and labels.

Product Liability Lawsuit Information

Companies sued in product liability cases include the manufacturer of the defective product, the wholesaler or distributor of the product and often the retailer of the product. There are three kinds of product liability cases:

  • A design defect (the product was manufactured as intended but it was inherently unsafe),
  • A manufacturing defect (the design of the product was adequate but this particular product was not made correctly), and
  • A failure to warn or instruct (the instructions for and warnings about use of the product were inadequate).

In practical terms this means the manufacturer has a duty to "design out" dangers inherent in the product. If the defect cannot be designed out, the manufacturer has to guard against such hazards. If the danger cannot be designed out or guarded against, the manufacturer must warn and instruct users of dangers inherent in the product.

Product liability is generally considered a strict liability claim. This means the degree of carefulness by the defendant is not an issue in the case. It is irrelevant whether the manufacturer or supplier exercised due care; if there is a defect in the product that causes harm, he or she will be liable for it.

Tips from Product Liability Lawyers

  • Save or retain the product and any documents or packaging that accompanied it.
  • Identify as much information about the product as possible including the name of the manufacturer, model name and number, place and date of purchase and serial number.
  • Store it in a safe place and do not modify or change it.
  • Obtain the name, address and telephone number of any witnesses.
  • Do not discuss the case with anyone and do not give any written or recorded statements about it.

Kawasaki ATV Recall
Kawasaki Motors Corp. has recalled about 6,000 2008 Model Year KFX 50 and KFX 90 Youth ATVs. The throttle can fail to return to the idle position when released or could fail to be at idle on start-up. Stanley Crib Recall
Stanley Furniture Company has recalled about 1,200 2nd Nature Built to Grow Cribs. The cribs could fail to meet a federal safety standard for crib dimensions. When the mattress support is in the middle setting, the space between the mattress and the crib could be too wide, posing an entrapment hazard to infants. Read about the Stanley crib recall.

KYMCO Mongoose Youth ATV Recall
KYMCO USA has recalled about 1,700 2008 Model Year Mongoose Youth ATVs. A manufacturing defect in the carburetor can cause the throttle to stick open, posing a risk of serious injury or death to the rider. Read about the KYMCO Mongoose ATV recall.

Arctic Cat ATV Recall
Arctic Cat has recalled about 6,000 youth model Arctic Cat ATVs: Model Year 2008 Arctic Cat 50cc and 90cc All-Terrain Vehicles (ATVs). Read about the Arctic Cat ATV recall.

Jardine Crib Recall
Jardine Enterprises has recalled about 320,000 Jardine cribs. The wooden crib slats and spindles can break, creating a gap, which can pose an entrapment and strangulation hazard to infants. Read about the Jardine Crib recall.

Wal-Mart Charm Key Chain Recall
Wal-Mart has recalled certain key chains because the charms contain an excessive amount of lead. The Illinois Attorney General informed Wal-Mart and CPSC on April 16, 2008, that the key chain was found in the home of a 9-month-old child who was discovered to have high blood-levels of lead.
