The state of Colorado drunk driving laws differentiate between driving under the influence of alcohol (.08+ BAC) and driving while alcohol impaired (.05 - .07 BAC). Additionally, under the principle of expressed consent, Colorado law presumes that every driver has consented to take a blood, breath, saliva, or urine test when requested to do so by a law enforcement officer who has probable cause to believe that the person is DUI or DWAI. (Section 42-4-1301.1, C.R.S.)

Under DUI law in Colorado, it is a crime to drive, operate or be in control of any motor vehicle anywhere in the state under the following conditions:

Non-commercial drivers age 21+ are considered legally drunk when their blood alcohol level is .08 or more (.08 means .08 percent alcohol concentration, which is 8/10,000ths by volume).
Drivers of commercial vehicles are legally drunk when their blood alcohol level is .04 percent or greater. In Colorado, school bus drivers are commercial drivers.
Drivers under 21 are legally drunk when their blood alcohol level is .02 or more.
