Dorel Lawsuit: Victim Compensation
If your child has been injured or killed, and you suspect that the cause is a defective Dorel product, you and your surviving child may have claims against Dorel and others. In a Dorel injury claim, money compensation can include amounts for medical expenses, cost of care, lost income, pain and suffering, emotional distress, disfigurement, loss of quality of life and other damages.
A Dorel wrongful death claim would be governed by state law. Each state has different laws about the type of losses for which wrongful death compensation is allowed:
- All states allow for the recovery of lost income the decedent would have provided his loved ones.
- Most states do not allow recovery for grief or anger suffered by the surviving heirs, but do allow money damages for the loss of advice, care, comfort and companionship the deceased would have provided had he or she lived.
- Some states also allow money damages for the pain and suffering of the deceased person prior to death.
Dorel Recalls
Dorel Juvenile Group Recalls Nearly 800,000 Child Safety Seats
The recall was issued on February 15, 2011 and includes car seats sold under the brand names of Cosco, Maxi-Cosi, and Safety 1st brands. This car seat has been under investigation since March 5, 2010 and was sold at Wal-mart, K-Mart, Target, Amazon.com and other retailers. The center front adjuster button sticks and does not always lock into place, allowing the harness to loosen and endanger the child in the event of an accident.
One Death, 10 Injuries Prompts Dorel Asia Crib Recall
A Dorel crib recall in January 2010 involved 635,000 defective cribs that posed strangulation and suffocation hazards to children. Dorel Asia, SRL, a division of Dorel Industries, Inc., recalled the hazardous cribs after reports including the death of one child in Cedar Rapids, Iowa who became entrapped in the crib and strangled, and ten other crib entrapment injury reports. The company has received 31 reports of incidents involving hazards posed by the crib’s drop side and 36 reports of crib slats breaking. The hazardous cribs were sold nationwide from January 2005 through December 2009 at Kmart, Sears and Walmart. Read about a Dorel crib lawsuit.
Dorel Recalls Safety 1st, Cosco, Eddie Bauer and Disney Brand Car Seats and Carriers

Dorel Play Yards and Bassinets Recalled Over Suffocation Hazard
A December 2009 Dorel Juvenile Group recall involves the Safety 1st Disney Care Center and Eddie Bauer Complete Care Play Yard that could pose a positional asphyxiation hazard (suffocation hazard) to children. About 213,000 products were recalled by the firm because the metal bars supporting the bassinet floorboard can come loose from plastic sleeves, creating an uneven sleeping surface and a potential suffocation hazard. The defective playpens and bassinets were sold at Babies R Us, Kmart, Sears, Target and Walmart from January 2007 through October 2009. They include the following model numbers: 05025, 05026, 05037, 05088 and 05350. The recalled units have “Safety 1st” or “Eddie Bauer” printed near the bottom of the fabric sides.
Suffocation Hazard Prompts Dorel Recall of Eddie Bauer Brand Play Yards with Rocking Bassinets
About 71,000 Eddie Bauer Soothe & Sway Play Yards were recalled in May 2009 by Dorel Juvenile Group because the rocking bassinet attachment to the play yard can tilt even when secured in the non-rocking position. This creates an uneven sleeping surface which can cause the infant to roll to the side or corner of the bassinet and become pressed against these surfaces, posing a suffocation hazard by positional asphyxiation. The CPSC received one report of an infant pressed against the bassinet side who was turning purple and out of breath when found. Six other children were found in a similar position though with no symptoms of suffocation. In all, the CPSC received 10 reports of rolling incidents.
The models included in this recall include all units of model 05046 and 05044 units manufactured before December 1, 2008. Model numbers and manufacture dates can be found on a sticker on one of the play yard’s legs. The play yards were sold at Target, Sears, and Burlington Coat Factory nationwide and through Internet sales from January 2008 through May 2009.
Cosco Rock n Roller Baby Strollers Recalled After Fall Injuries Reported
Cosco, a division of Dorel Juvenile Group, recalled 300,000 strollers in June 2004. There were 77 reports of problems related to the detachable stroller seats, including one report of a child who fell and had a concussion, one child who required stitches and 46 reports of children falling and suffering bumps and bruises. The fall hazard is created if certain pins are bent or missing from the detachable seat. Therefore the stroller seat isn’t fully attached and can come loose from the stroller frame, allowing the child to fall.
The recalled strollers have dark blue or green metal frames that contain a label on the back which has one of these model numbers:
- 01-654
- 01-622
- 01-624
- 01-646
- 01-656
The recalled Rock N Roller strollers were sold nationwide at Wal-Mart, Kmart, Sears, Toys R Us, Target, JC Penney, Service Merchandise and other toy and children's furniture stores from April 1996 through August 2002.
Cosco Car Seat and Carrier Recall due to Fall Hazard; Nine Injuries Reported
A Cosco car seat and child carrier recall was originally issued in 1999 due to faulty plastic handle locks that could break, causing the carrier seat to unlatch or flip forward, allowing the child to fall out of the carrier. The recall was expanded in 2003 when Cosco, now part of Dorel Juvenile Group, added 1.2 million car seats/carriers to the original 670,000 that were recalled. At the time of the 2003 car seat and carrier recall expansion, Dorel had received 416 reports of handles breaking or unlatching. Nine injuries were reported, including bruises and scratches to children’s heads and face. The recalled defective carriers and car seats include the Cosco “Arriva” and “Turnabout” models with the following model numbers: (paste chart here)
The model numbers can be found on the instruction and warning label on the side of the car seat/carriers. The hazardous car seats were sold at juvenile product stores, department stores, mass merchandise stores, and discount stores from September 1997 through 2000.
Infant Suffocation Prompts Cosco Playpen Recall by Dorel
About 102,000 Cosco "Zip n Go," "Okie Dokie," and "Carters" playpens were recalled by Dorel Juvenile Group in October 2001 after an Elyria, Ohio infant died when the sides of his playpen collapsed and his chest was caught in the V shape created by the collapse.
These playpens have plastic tabs that lock corner rails in place, but these tabs can break or come loose, allowing the rails to collapse inward and entrap the infant. Dorel received 421 of rails collapsing or failing to lock. The recall includes model numbers 05-361, 05-362, 05-363, and 05-364, which can be found on a label on the bottom of the playpen. The “Okie Dokie” playpens were sold exclusively at JC Penney stores nationwide and the “Zip n Go” and “Carters” brands were sold at department stores and toy and juvenile specialty stores. All were sold between May 1995 and December 1999.
Dorel Juvenile Group Subsidiaries Cosco and Safety 1st Pay Historic $1.75 Million Fine to CPSC
In April 2001, the Consumer Product Safety Commission (CPSC) fined Cosco and Safety 1st a total of $1.75 million in civil penalties for failing to report product defects that caused death and serious injury to infants. According to the CPSC announcement, “under federal law, companies are required to report to CPSC if they obtain information that reasonably suggests that one of their products could present a substantial risk of injury to consumers, or creates an unreasonable risk of serious injury or death.”
Cosco paid $1.3 million to the CPSC for failing to report defects relating to cribs, strollers, car seat carriers and high chairs. The CPSC attributed two infant deaths and more than 300 child injuries to these products and stated that at the time of this fine, Cosco was the largest manufacturer of strollers and car seats in the United States. Safety 1st paid $450,000 regarding walkers and wipe warmers that caused six child injuries.
"This is the largest fine against a manufacturer of children's products in CPSC's history," said then-CPSC Chairman Ann Brown in the commission’s announcement of the fine.
Although the Dorel subsidiaries agreed to pay the fines, both denied CPSC’s charges.
