Other Driver at Fault

Percentage of Fault Determines Compensation Amount

In every wrongful death accident, the law looks at fault to determine if the family can be compensated under the state wrongful death statute. The law says the fault of all of the drivers involved in an accident must add up to 100%. There are three possibilities:

  • Semi Truck Rear Ended CarYour deceased family member was 0% at fault and the other driver was 100% at fault. For example, if your family member was killed when rear ended by a negligent semi truck driver, your family member will probably be found 0% at fault and the semi driver 100% at fault.
  • Your deceased family member was at fault, but less than 50%. If  your family member is found at fault for 20% of the accident, for example, the money your family would otherwise be entitled to collect from the other person's insurance would be reduced by 20%. This means that even if your wrongful death claim is worth $100,000 you would get only $80,000, a 20% reduction based upon your family member’s percentage of the fault.
  • Your deceased family member was over 50% at fault. In this case, your family will get nothing.
