Accident Involving a Turn at an Intersection
When an accident happens in an intersection, it is important to determine if one of the drivers violated Minnesota turning laws (Minnesota Statutes, Sec. 169.19, subd.1):
- Both the approach for a right turn and a right turn shall be made as close as practicable to the right-hand curb or edge of the roadway.
Approach for a left turn on other than one-way roadways shall be made in that portion of the right half of the roadway nearest the centerline thereof, and after entering the intersection the left turn shall be made so as to leave the intersection to the right of the centerline of the roadway being entered. Whenever practicable the left turn shall be made in that portion of the intersection to the left of the center of the intersection.- Approach for a left turn from a two-way roadway into a one-way roadway shall be made in that portion of the right half of the roadway nearest the centerline thereof and by passing to the right of such centerline where it enters the intersection.
- A left turn from a one-way roadway into a two-way roadway shall be made from the left hand lane and by passing to the right of the centerline of the roadway being entered upon leaving the intersection.
- Where both streets or roadways are one way, both the approach for a left turn and a left turn shall be made as close as practicable to the left-hand curb or edge of the roadway.
- Whenever it is necessary for the driver of a motor vehicle to cross a bicycle lane adjacent to the driver's lane of travel to make a turn, the driver shall drive the motor vehicle into the bicycle lane prior to making the turn, and shall make the turn, yielding the right-of-way to any vehicles [this includes bicycles] approaching so close thereto as to constitute an immediate hazard.
U-Turns
No u-turns near curves, the crest of a grade, where the vehicle turning cannot be seen by the driver of any other vehicle approaching from either direction within 1,000 feet, or unless the u-turn can be done safety and without interfering with other traffic (Minnesota Statutes, Sec. 169.19, subd.2).
Moving from a Parked Position
A driver shall not move a vehicle which is stopped, standing, or parked unless and until such movement can be made with reasonable safety (Minnesota Statutes, Sec. 169.19, subd.3).
Change of Course – Includes Lane Changes
A driver shall not turn a vehicle at an intersection unless the vehicle is in proper position upon the roadway (see above), turn a vehicle to enter a private road or driveway unless and until it can be done safely, or turn a vehicle from a direct course or move right or left upon a highway unless and until the movement can be made with reasonable safety after giving an appropriate signal in the manner hereinafter provided—take heed drivers who swerve at the last minute to get onto a freeway ramp or carelessly change lanes (Minnesota Statutes, Sec. 169.19, subd.4).
Signal to Turn
A driver shall signal an intention to turn right or left continuously during not less than the last 100 feet traveled by the vehicle before turning (Minnesota Statutes, Sec. 169.19, subd.5).
Signal to Stop
A driver shall not stop or suddenly decrease the speed of a vehicle without first giving an appropriate signal to the driver of any vehicle immediately to the rear, unless there is a good and sufficient reason for not being able to do so (Minnesota Statutes, Sec. 169.19, subd.6).
Compensation for Victims and Families
Violating Minnesota traffic laws is prima facie evidence of driver negligence. If the defendent does not provide sufficient evidence to the contrary, the driver at fault, the owner of the vehicle (for example a car or commercial truck), and others may be liable for damages, meaning they are responsible for compensating the victim(s) of the accident and their families for losses suffered.
