Personal Injury Compensation When the
Other Driver is at Fault for the Accident
If you or a loved one sustained a personal injury in an auto accident, the amount of money recoverable from insurance companies will depend, in part, on who was at fault.
Many states, including Minnesota, require drivers to have no-fault insurance. This usually involves payment of medical expenses, the value of the car and other amounts no matter who was at fault. There are two important things to know about this kind of insurance:
- The amount of money available under your no-fault policy is limited and may not cover all of your medical expenses, etc.
- No-fault policies usually do not provide amounts for pain and suffering, which includes compensation for physical pain, emotional distress, disability, disfigurement, loss of quality of life, and similar losses.
The only way you will be able to recover more money for medical expenses, lost income and pain and suffering is to prove that the other driver was at fault. If this can be done, the at-fault driver’s insurance company will pay up to the policy limit.
If you were partially at fault, you will get less money than if the other driver was 100% at fault. For example, if the evidence shows that the value of your pain and suffering is $100,000 and you were 25% at fault, you will only get $75,000. If you were more than 50% at fault for the accident, you will not get anything from the other driver’s insurance company.

It is best to hire an attorney to pursue the at-fault driver and his or her insurance company. Within 24 hours of the accident, you will get calls from the at-fault driver's insurance company. DO NOT TALK TO THEM. The goal of the insurance company is to pay as little as possible. Part of their strategy is to try gather evidence from you that will help them. In addition, they may offer you money if you sign a waiver of liablility. If you do this, you will not be able to sue them for more money, even if your injuries are far worse than you initially thought. Also, our experience is that the insurance companies offer far less money than they know your case is worth.
