Drunk Driver Broadsides Van in Olmsted County
Four people died in a drunk driving accident in Olmsted County on May 23, two were critically injured.
The victims were in a van that was broadsided at the intersection of highway 36 and highway 30 by a drunk driver. The driver, Christopher Frisch of Winona, MN, who was not apparently injured, was arrested.
Alcohol was not detected on any of the victims.
Drunk Driving, Speeding and Failure to Yield the Right-of-Way
The fatal drunk driving accident in Olmsted County was a broadside accident (also called a side-impact collision) in an intersection. The drunk driver plowed into the side of the van at such a speed that 4 people were killed.

Under Minnesota law, it is a violation of Minnesota law to drive with an alcohol concentration of .08 or more (Minnesota Statutes, Section 169A).
Speeding
Minnesota law sets speed limits (Minn. Statutes, Sec. 169.14, subd. 2) and also requires drivers to only go as fast as is reasonable under the circumstances.
Failure to Yield the Right-of-Way
Minnesota law has specific right-of-way provisions (Minnesota Statutes, Section 169.20).
If someone violates a Minnesota traffic law, it is prima facie evidence of negligence in a civil case (Minnesota Statutes, Section 169.96 (2006)). Under certain circumstances, accident victims and their families may seek punitive damages, i.e., monetary amounts sufficient to punish the person at fault.
Liability of Bars, Restaurants and Other "Dram Shops"
Because this case involves drunk driving, a bar, restaurant and other seller of liquor (referred to in the law as "dram shops") may be liable to the injured people and the families of the people killed.
