Money Damages beyond No-Fault Limits
To bring a claim for pain and suffering and other damages beyond Minnesota no-fault insurance limits, the injury has to be “serious” as defined in Minnesota law (Minn. Stat., sec. 65B.51(3)):
- Medical expenses in excess of $4,000
- Permanent injury
- Permanent disfigurement
- Disability of more than 60 days or
- Death

Compensation for the Spouse of an Injured Person
Under Minnesota law, the spouse of a person seriously injured in an auto accident may have a claim for "loss of consortium," which means the loss of the injured spouse's society, affection, assistance and intimate relations.
Compensation for the Parents of an Injured Child
When a child is seriously injured, the parents may have a claim against the party at fault for the child's medical expenses and the loss of a child's services.
Recent Minnesota case law has also recognized a claim by a parent for emotional distress when the parent witnesses the child being seriously injured or killed. This claim is limited to situations where the parent is "in the zone of danger of physical impact," the parent feared for his or her own safety, and the parent had severe emotional distress with attendant physical manifestaions (Engler v. Illinois Farmers Insurance Co., 106 NW2d 746 (Minn. 2005)). In Engler, a mother witnessed a child getting hit by a car. The court's opinion in this case suggests that spouses and others may have a similar claim.
Compensation for Wrongful Death
If someone dies in a car accident, the family can sue the parties at fault for compensation. Minnesota law provides some basic MN no-fault survivors' benefits, but compensation in accident death cases can be hundreds of thousands of dollars—even millions of dollars—beyond these basic survivors' benefits.
