One of the cases we are working on involves a pedestrian that was struck by a bus while he was in the crosswalk.  We investigated the case, and one of the things we learned was that the bus driver, at the time he struck the pedestrian in the crosswalk, was distracted by talking to a passenger.  This is something we often see in bus accident cases.  We deal with many distracted driver cases, but in the bus accident context, one of the things we see is that the passengers, oftentimes, are the distraction for the bus driver. And that was true in this case.

Our client was simply crossing the street in the crosswalk.  The bus approached the intersection to turn left.  As the bus was approaching the intersection, a passenger distracted the driver, asked him for directions, and the bus driver turned to answer.  As he did so, he made a turn and ran over our client in the crosswalk, severely injuring him and causing traumatic brain injury.

So discovering that the driver was distracted was a significant part of this case.  Liability was very clear from the start and our job was to establish how seriously hurt our client was.
