Strain Tours Bus Rollover Accident
According to the Minnesota State Patrol, a tour bus rolled over at about 3:20 today (November 18, 2009) on I-90 near Austin, Minnesota. The tour bus was headed eastbound on I-90 when it crossed into the westbound lanes and rolled over.
The bus rollover accident killed two and seriously injured several others.
On first glance, it appears that two people are dead and others injured because the bus driver negligently lost control of the bus.
The bus is owned by Bold Lines, Inc., doing business as Strain Tours, a Rochester, Minnesota bus company.
Tour Bus Company Liability
Tour buses should be extremely safe, and it is the responsibility of tour (charter) bus companies like Strain Tours of Rochester, MN to make sure that passengers on their buses arrive safely at their destinations. Buses are common carriers and are obligated under federal law to provide a high level of safety to their passengers.
Tour bus companies are liable for personal injuries to passengers if the driver was negligent, poorly trained or driving under the influence or if the bus was not properly maintained. Tour buses are common carriers under federal and state law, and are, therefore, obligated to provide a higher level of safety to the passengers.
Under Minnesota law, if a personal injury occurs because the carrier was not in compliance with safety regulations, the carrier may have total liability for personal injuries. A traffic law or other safety violation is prima facie evidence of negligence, meaning negligence will be found if there was not a very good excuse for the violation.
Minnesota Tour Bus Accident Victim Compensation
If someone is injured in a tour (charter) bus accident, they can sue the bus company for compensation. Compensation can include amounts for the following: medical expenses, lost income, pain and suffering, emotional distress, disability, loss of quality of life and other damages.
If someone is killed in a tour (charter) bus accident, their family can file a wrongful death lawsuit against the bus company.
