Elements of a Burn Injury Lawsuit

The elements of a burn injury lawsuit depend on the facts.  Most burn injury lawsuits are based on negligence, which involves the careless actions or inactions of another.  The four elements of negiligence are as follows:

  1. Duty
  2. Breach of Duty
  3. Direct or Proximate Cause
  4. Injury

Each of the above elements has to be proven by a preponderance of the evidence.  If the burn injury lawsuit involves a recalled defective product and the burn is attributable to that product, the case is one of strict liability, meaning cause is considered proven.  If the burn injury resulted in death, the burn injury lawsuit becomes a wrongful death case.

As an example of negligence, in one of Pritzker | Olsen, P.A.'s multi-million-dollar cases, the owner of an apartment building did not repair smoke alarms in the building.  Owners of apartment buildings have a duty to maintain the building, including smoke alarms.  Two occupants of one apartment died, and two others in the same apartment were injured.

Burn on LegBurn injury lawsuits can require the expert testimony of medical doctors, biomedical professionals and engineers. Pritzker | Olsen, P.A. has the resources to get qualified expert witnesses and pay for visuals that will make their testimony come alive in court.
