Compensation for Burn Injury Victims
Compensation for burn injuries is called “damages” in a burn injury lawsuit. Burn injuries can include injuries to any part of the body, including the skin, eyes, lungs and brain. Hands, feet, arms and legs can be so badly burned that amputation is necessary.
The following damages can usually be claimed in a burn injury lawsuit:
- Actual Damages:
- Medical expenses
- Pain and suffering, including physical pain, suffering, emotional distress, disfigurment, disability, mental impairment
- Lost earnings, including lost potential earnings
- Cost of care
- Punitive Damages – This is an amount awarded to a burn victim as a means of punishing the person responsible.
If the burn victim dies, the case becomes a "wrongful death" case, and in many states, including Minnesota, a state "wrongful death" statute governs what damages can be claimed and who can be compensated. Read about burn injury wrongful death.
