Parkers Farm Recall Lawsuit

On January 8, 2010, Parkers Farm, Inc., a Coon Rapids, Minnesota firm, recalled peanut butter, bagel spreads, dips, cheese and salsa due to possible contamination with Listeria monocytogenes, a life-threatening foodborne pathogen that causes listeriosis, which can lead to brain damage, sespticemia, pneumonia, hydrocephalus, meningitis and death. Pregnant women are at risk of having a miscarriage, stillbirth or premature birth. Babies who survive may be born with listeriosis and die within a few days.

Although no illnesses have been reported to either Parkers Farms or the U.S. Food and Drug Administration (FDA), Listeria has an extremely long incubation period, up to 70 days, which means someone who consumes a product contaminated with Listeria may not show any signs of illness until 3 months after consumption. This can make proving a Listeria case difficult, but our Listeria attorneys have experience using both microbiological and epidemiological evidence to recover money for Listeria victims.

Both the State of Wisconsin and the State of Minnesota tested samples of the recalled products and found that some finished product contained Listeria monocytogenes.

SUPERVALUE Recall - Macaroni and Cheese

SUPERVALU INC.® is voluntarily recalling frozen Culinary Circle™ Gourmet Macaroni and Cheese products because they may have the potential to be contaminated with Listeria monocytogenes.

The recalled SUPERVALUE macaroni and cheese products are found in the frozen foods section in a 38 oz. package and were sold at SUPERVALU-owned stores including Acme®, Albertsons®, bigg’s®, Cub Foods®, Farm Fresh®, Hornbacher’s®, Jewel-Osco®, Lucky®, Shaw’s/Star Market™, Shop ‘n Save®, and Shoppers Food & Pharmacy® in all of the states where they operate.

This SUPERVALUE recall includes all Culinary Circle Gourmet Macaroni and Cheese, a frozen product sold in 38 oz. package. The UPC number for the recalled products is 41130 38704.

The possibility for contamination was identified through routine sampling of the product at the manufacturing facility. There have been no reported illnesses associated with the identified product.

Listeria Found in Duck Leg and Kolbase

Listeria monocytogenes was detected in duck and sausage products made by a company in Long Island, New York, prompting a recall of 564 pounds of the meat, which was produced May 13 and sold to restaurants and distributors in the East and Northeast.

Schaller Mfg. Corp. announced the recall yesterday in conjuction with the USDA's Food Safety and Inspection Service (FSIS). The regulator said it had not received any reports of illness in association with the contamination, which was found in company testing.

Consuming Listeria monocytogenes can cause an uncommon but potentially fatal disease -- listeriosis. Symptoms can include high fever, neck stiffness, severe headache and nausea. Listeriosis is a particular threat to pregnant women, causing stillbirth and miscarriage.

The duck products were sent to distributors and restaurants in Connecticut, the District of Columbia, Maryland, Massachusetts, New York, New Jersey, Pennsylvania and Rhode Island.

The sausage products were sent to distributors and restaurants in New Jersey, New York, North Carolina, Tennessee and Virginia as well as the company's retail store in New York City. The problem was discovered through the firm's microbiological sampling program. FSIS has received no reports of illnesses associated with consumption of this product.

Refrigerated Potatoes Recalled Over Listeria Test

Various packages of Simply Potatoes refrigerated potatoes have been recalled by Northern Star Co. after the Minnesota Department of Agriculture detected Listeria monocytogenes in a sample of Southwest Style Hash Browns.

The bacteria can be harmful to pregnant women and to people with weakened immune systems, including young children and the elderly.

Listeria: American Sub Recall

Landshire, Inc. has recalled its American Sub sandwich because it has the potential to be contaminated with Listeria monocytogenes, an organism which can cause serious and sometimes fatal infections in young children, frail or elderly people, and others with weakened immune systems. Pregnant women are particularly susceptible to contracting Listeria infections, which can lead to miscarriage, stillbirth or an infant born with severe illness that could result in death.

The recalled American Sub sandwiches were distributed in the Midwestern States of: Indiana, Kentucky, Ohio and Pennsylvania. The recalled American Sub sandwiches were sold to Circle K Convenience Stores exclusively. There were 812 sandwiches produced on lot number 21882.

The American Sub sandwich label identifies it as: "Fresh from the Deli" American Sub. This is a pre-packaged, individually wrapped (clear plastic) with a black tray inside of package. Sandwich weight is 9.75ounces (276grams). UPC code is 9748800540. The American Sub sandwiches involved have a lot number of 21882. The lot number is printed in black ink on the side of the package.

Langostino Recall Due to Listeria Risk

Slade Gorton & Co has issued a voluntary recall of its "ICYBAY" cooked, ready to eat, frozen langostinos because they have the potential to be contaminated with Listeria monocytogenes.

The recalled langostinos retail in one pound, clear plastic package marked with UPC 0-73129-61672-8 on the top and with an expiration date of June 2009 and is distributed under the brand name of "ICYBAY". The recalled langostinos were also distributed to wholesale accounts, also under the "ICYBAY" brand, in five pound clear plastic packages containing either 70-90 count, 90-125 count or 120-150 count. This recall involves production dates of July 18, 2007 through August 13, 2007 and/or Julian dates of 199 through 232.

The recalled "ICYBAY" cooked langostinos were distributed to retailers in Massachusetts and Maryland, over the course of the past several weeks. The majority of the retail distribution was removed from shelves immediately upon notice of the potential of contamination. The recalled "ICYBAY" cooked langostinos were distributed to wholesalers in Colorado, Connecticut, Indiana, Maine, Maryland, Massachusetts, Michigan, Minnesota, Nebraska, New Jersey, New York, North Carolina, Pennsylvania, Ohio, Oklahoma, Texas, Vermont, West Virginia and Wisconsin.

The potential for contamination was noted after a Canadian government laboratory, CFIA, found that one sample was believed to be contaminated with Listeria monocytogenes.
No illnesses (listeriosis) have been reported to date in connection with this product.

President Kim Gorton said her company, one of the largest private seafood distributors in the United States, strictly follows HACCP procedures and FDA guidelines for testing its seafood products to ensure their wholesomeness and safety.

She said that "while the report from Canada only involves a small sample of the langostinos, we are issuing this voluntary recall, as a precautionary measure, out of concern for the health and safety of the consuming public."

Distribution of the product has been suspended while FDA and the company continue to confirm testing and investigate the source of any potential problem. Slade Gorton & Co. will use an independent testing service to determine the accuracy of the Canadian findings.

Double B Foods, H-E-B, Smokeys, Southern Heritage and Wheeler Sausage Rolls Recalled

UDSA-FSIS has announced a Double B Foods sausage roll recall involving about 98,000 pounds of frozen sausage roll products due to possible contamination with Listeria monocytogenes. The frozen sausage roll products were produced by Double B Foods on various dates between Oct. 25 and Nov. 6, and were distributed to retail establishments in Texas, and institutions, catalogue sales and distribution centers in Alabama, Arkansas, Florida, Georgia, Louisiana, Mississippi, New Jersey, New Mexico, New York, Oklahoma, Pennsylvania and Texas. The recalled sausage rolls were sold under a number of brands and may have been repackaged. The brands named in the FSIS announcement of the frozen sausage roll recall are Double B Foods, H-E-B, Smokey’s, Southern Heritage, and Wheeler.
