Texas Star Meat Beef Brisket Recall

On October 21, 2009, Lone Star Brisket Company, a Thorndale, Texas firm, has recalled approximately 14 pounds of smoked beef products that may be contaminated with Listeria monocytogenes.

The following products are subject to recall:
  • 2.5- 3-pound vacuum sealed packages of "Texas Star Meat Company HALF SMOKED BEEF BRISKET Fully Cooked." Each label bears the establishment number "EST. 27340" inside the USDA mark of inspection and a day-glo sticker "SLICED" next to the product label. Each package also has a Use By/Sell By date of "12/16/09," and can also be identified by the case code "285A."
  • 4-5-pound vacuum sealed packages of "Texas Star Meat Company WHOLE SMOKED BEEF BRISKET Fully Cooked." Each label bears the establishment number "EST. 27340" inside the USDA mark of inspection and a day-glo sticker "SLICED" next to the product label. Each package also has a Use By/Sell By date of "12/16/09," and can also be identified by the case code "285A."
The smoked beef brisket products were packaged on October 14, 2009 and distributed to a Department of Defense Commissary in Oklahoma City, Okla.

The problem was discovered through FSIS's microbiological sampling program. FSIS has received no reports of illnesses associated with consumption of this product.

Eggo Waffle Recall Due to Listeria

A frozen food plant in Atlanta has been closed for a deep cleaning by Kellogg Company after state inspectors found Listeria monocytogenes in a pack of waffles.

The finding also prompted a recall by Kelloggs of certain Eggo Cinammon Toast waffles and Eggo Toaster Swirlz Cinammon Rolls Minis.

The recalled waffles, according to a press release by the Georgia Department of Agriculture, Health, have a UPC code of 3800040440 and "Best if used before'' dates of NOV22 10 EA, NOV23 10 EA, NOV24 10E.

The recalled toaster swirlz have a UPC code of 3800023370 and "Best if used before'' date beginning with Nov. 15.

Peregrina Cheese Recall - Listeria

If you or a family member has contracted listeriosis (Listeria infection) after consuming Peregrina cheese, contact our law firm. If you have any recalled Peregrina cheese in your home, do not eat it.

Peregrina Cheese Corporation of Brooklyn, New York, is recalling all products manufactured in its Brooklyn, NY plant from March 17, 2009 to the present because they have the potential to be contaminated with Listeria monocytogenes, an organism which can cause serious and sometimes fatal infections (listeriosis, listeria meningitis) in young children, frail or elderly people, and others with weakened immune systems. Listeria infection can cause miscarriages and stillbirths among pregnant women.

The recall action involves the following products produced since March 17, 2009:

    • Peregrina Cheese brand QUESO FRESCO Fresh Cheese, 14 Oz. (397 g) foil-wrapped package, Plant # 36-8431, UPC 8 17424 00024 6, all lot codes on the market produced since March 17, 2009.
    • Chipilo brand MEXICAN CHEESE QUESO FRESCO – Fresh Cheese, NET WT. 15 oz. (425g), Plant #36-8431, UPC 8 17424 00028 4, all lot codes on the market produced since March 17, 2009.
    • Peregrina Cheese brand QUESO HEBRA Queso Oaxaca, NET WT. 15 Oz. (425g), Plant #36-8431, UPC 8 17424 00026 0, all lot codes on the market produced since March 17, 2009.
    • Peregrina Cheese brand QUESO COTIJA MOLIDO, NET WT. 15 OZ. plastic bags, Plant # 36-1388, UPC 8 17424 00027 7, all lot codes on the market produced since March 17, 2009.
    • Peregrina Cheese brand Flan, NET WT 8 oz., Plant # 36-8431, UPC 8 17424 00026 0, all lot codes on the market produced since March 17, 2009.
    • Peregrina Cheese brand GELATIN, NET WT. 10 OZ., Plant # 36-8431, UPC 8 17424 00031 4, all lot codes on the market produced since March 17, 2009.
    • Peregrina Cheese brand CREMA MEXICANA Mexican Cream, Weight 16 Oz., Plant # 55-8991, UPC 8 17424 00030 7, all lot codes on the market produced since March 17, 2009.

The products were distributed to retail stores in New York and Pennsylvania.

No illnesses have been reported to date, but the incubation period for Listeria can be as long as 70 days.

Listeria Found in Duck Leg and Kolbase

Listeria monocytogenes was detected in duck and sausage products made by a company in Long Island, New York, prompting a recall of 564 pounds of the meat, which was produced May 13 and sold to restaurants and distributors in the East and Northeast.

Schaller Mfg. Corp. announced the recall yesterday in conjuction with the USDA's Food Safety and Inspection Service (FSIS). The regulator said it had not received any reports of illness in association with the contamination, which was found in company testing.

Consuming Listeria monocytogenes can cause an uncommon but potentially fatal disease -- listeriosis. Symptoms can include high fever, neck stiffness, severe headache and nausea. Listeriosis is a particular threat to pregnant women, causing stillbirth and miscarriage.

The duck products were sent to distributors and restaurants in Connecticut, the District of Columbia, Maryland, Massachusetts, New York, New Jersey, Pennsylvania and Rhode Island.

The sausage products were sent to distributors and restaurants in New Jersey, New York, North Carolina, Tennessee and Virginia as well as the company's retail store in New York City. The problem was discovered through the firm's microbiological sampling program. FSIS has received no reports of illnesses associated with consumption of this product.

Bean and Soy Sprouts Recalled Over Listeria

More sprouts are being recalled, this time for the possible presence of Listeria monocytogenes.

The action was announced Thursday by Chang Farm of Whatley, Massachusetts.

In a press release placed on the Food and Drug Administration's food safety website, the company said its bean and soy sprouts may be contaminated with Listeria but that no illnesses have been reported.

The produce -- packed in 10-pound bulk bags and 12-ounce plastic bags for retail, are distributed to retail stores and restaurants throughout Massachusetts, Connecticut, New York and New Jersey.

Sold under the Chang Farm label, the soy sprouts have a “Sell By” date of May 23, 2009, or May 24, 2009. Bean sprouts have a “Use By” date of May 23, 2009, or May 24, 2009.

The contamination was discovered in a test sample taken at a retail store in New York, the company said.

Listeria can cause potentially deadly infections in young children, the elderly and people with weakened immune systems. A Listeria outbreak in Canada last year killed 22 people. For pregnant women, Listeria carries the additional threat of miscarriage and stillbirth.

Earlier this spring, the FDA and Centers for Disease Control advised consumers not to eat raw alfalfa sprouts because they may be contaminated with Salmonella that infected seeds at various growers.

Amalgamated Produce Inc. Sprouts and Listeria

Amalgamated Produce Inc. of Bridgeport, Connecticut, has issued its second consumer recall notice over possible Listeria monocytogenes contamination of raw sprouts.

The latest recall applies to four-ounce plastic containers of Specialty Farms Organic Crunchy Sprouts or Organic Crunchy Pea Mix. The packages have sell-by dates from March 31 to April 27, 2009. The company sells in 11 northeastern states.

Amalgamated's first recall notice happened April 9 after an inspector from the New York State Department of Agriculture and Markets took a random sample, tested it and found it to be contaminated with Listeria.

The first recall applied to raw sprouts with the following labels:
  • Specialty Farms
  • Vermont Sprout House
  • Nature's Promise
  • Brocco Sprouts
The U.S. Centers for Disease Control and Prevention has not linked Amalgamated's recall to any outbreak, but the CDC did say in a recent press release that it was investigating an outbreak of Listeria monocytogenes infections linked with eating alfalfa sprouts. The press release did not say what states or areas were involved in the outbreak.

Listeria Test Leads to Recall of Packaged Burritos

A Denver company has recalled 172 pounds of 5.3-ounce burritos sold individually in convenience stores Dec. 24 and 25 after tests by the USDA's Food Safety and Inspection Service (FSIS) found they may be contaminated with Listeria monocytogenes.

Home Fresh Sandwich Distributors Inc. made the products Dec. 23. In announcing the recall, the FSIS said no illnesses have been reported.

The recall pertains to 5.3-ounce packages of "7- ELEVEN Fresh to Go BURRITO WITH POTATOES, BACON, EGGS, & MONTEREY JACK CHEESE" with a "Best By" date of "Thursday 1225." The products bear the establishment number "EST. 19496" inside the USDA mark of inspection.

Consumption of food contaminated by Listeria monocytogenes can cause listeriosis, an uncommon but potentially deadly disease. Symptoms include severe headache, neck stiffness and nausea.

While healthy people rarely contract listeriosis, it can cause serious injury or death to infants, the elderly or people who have weakened immune systems. Pregnant women who eat food containing Listeria monocytogenes are at risk for stillbirth and miscarriage.

Ohio Firm Recalls Sausage Over Listeria Concern

A company from Youngstown, Ohio, has recalled packages of Sopressata mild sausage after the U.S. Department of Agriculture's Food Safety and Inspection Service said the product might be contaminated with Listeria monocytogenes.

In a press release, the FSIS said late Friday that the product was produced in Canada Oct. 9 and distributed to a lone specialty retailer in Boardman, Ohio. No illnesses had been reported in connection with the finding, which happened in routine test sampling by the FSIS.

DeNiro Cheese of Youngstown said the one-pound packages are stamped with a use-by date of July 9, 2009. The product code is 91009 and the Canadian mark of inspection number is 476A.

When consumed, Listeria monocytogenes can cause Listeriosis, an uncommon but potentially fatal disease in children, the elderly and people who have weakened immune systems. The pathogen also can cause stillbirth or miscarriage in pregnant women.

New Jersey Schools - Listeria Risk

On December 25, 2007, the Maramont Corporation, a New York firm, recalled approximately 88 pounds of a beef patty product that may be contaminated with Listeria monocytogenes. Sale of Listeria-Contaminated Food Results in 15 Month Sentence

Timothy Delong, former president of Atlantis Foods, Inc., has plead guilty to charges of engaging in a scheme to defraud through the sale of adulterated food (food contaminated with Listeria monocytogenes), and a scheme to introduce misbranded food into interstate commerce in violation of Title 18, U.S.C. § 1341, and 21 U.S.C. §§ 331(a), 333(a)(2), and 343. R. Alexander Acosta, United States Attorney for the Southern District of Florida, David W. Bourne, Special Agent in Charge, Food and Drug Administration, Office of Criminal Investigations, and Lee Huttenbach, Special Agent in Charge, U.S. Department of Agriculture, Southeast Region, Office of Inspector General, announce that Mr. Delong was sentenced yesterday to fifteen (15) months in prison.

U. S. District Court Judge Daniel T. K. Hurley imposed the 15-month sentence and also ordered Delong to pay a fine of $5,000 and to pay restitution in the amount of $200,000 to the University of Florida’s Institute of Food and Agricultural Sciences to be used to support its programs in the area of food safety. The sentence will be followed by three years of supervised release.

Count 1 of the Information charged Delong with engaging in a scheme to defraud the customers of Atlantis Foods, Inc., where Delong served as president, through the sale of adulterated prepared foods. Delong, through Atlantis, sold chicken salad, Maine lobster dip, salmon cream cheese, salmon spread, chicken salad with almonds and cranberries, and crab stuffing which contained the harmful bacterium Listeria monocytogenes. Delong was president of Atlantis Foods, which on six occasions in 2003, allegedly produced and distributed food products containing Listeria monocytogenes. Delong failed to notify his customers after learning of the contamination and did not initiate a recall of the products.

Count 2 of the Information charged Delong with the introduction into interstate commerce of misbranded food, namely "Smoked Rainbow Trout Spread," between January 2002 and December 2003. According to court records, the spread, which listed trout as the first ingredient, was false and misleading in that the product in fact did not contain trout, but instead was made with tuna.

Mr. Delong's sentence seems light considering that he endangered the lives of thousands of people. Sentencing in these cases should serve to adequately punish the guilty individual and deter similar behavior. This sentence did neither.
