Parkers Farm Recall Lawsuit

On January 8, 2010, Parkers Farm, Inc., a Coon Rapids, Minnesota firm, recalled peanut butter, bagel spreads, dips, cheese and salsa due to possible contamination with Listeria monocytogenes, a life-threatening foodborne pathogen that causes listeriosis, which can lead to brain damage, sespticemia, pneumonia, hydrocephalus, meningitis and death. Pregnant women are at risk of having a miscarriage, stillbirth or premature birth. Babies who survive may be born with listeriosis and die within a few days.

Although no illnesses have been reported to either Parkers Farms or the U.S. Food and Drug Administration (FDA), Listeria has an extremely long incubation period, up to 70 days, which means someone who consumes a product contaminated with Listeria may not show any signs of illness until 3 months after consumption. Eggo Waffle Recall Due to Listeria

A frozen food plant in Atlanta has been closed for a deep cleaning by Kellogg Company after state inspectors found Listeria monocytogenes in a pack of waffles.

The finding also prompted a recall by Kelloggs of certain Eggo Cinammon Toast waffles and Eggo Toaster Swirlz Cinammon Rolls Minis.

The recalled waffles, according to a press release by the Georgia Department of Agriculture, Health, have a UPC code of 3800040440 and "Best if used before'' dates of NOV22 10 EA, NOV23 10 EA, NOV24 10E.

The recalled toaster swirlz have a UPC code of 3800023370 and "Best if used before'' date beginning with Nov. 15.

Peregrina Cheese Recall - Listeria

If you or a family member has contracted listeriosis (Listeria infection) after consuming Peregrina cheese, contact our law firm. If you have any recalled Peregrina cheese in your home, do not eat it.

Peregrina Cheese Corporation of Brooklyn, New York, is recalling all products manufactured in its Brooklyn, NY plant from March 17, 2009 to the present because they have the potential to be contaminated with Listeria monocytogenes, an organism which can cause serious and sometimes fatal infections (listeriosis, listeria meningitis) in young children, frail or elderly people, and others with weakened immune systems. Listeria infection can cause miscarriages and stillbirths among pregnant women.

The recall action involves the following products produced since March 17, 2009:

Torres Hillsdale Country Cheese Recall

Torres Hillsdale Country Cheese of Reading, Michigan announced a the recall of Oaxaca soft Mexican-style cheese due to potential Listeria monocytogenes contamination.

Products were distributed to the following states: Illinois and Minnesota.

The recalled Oaxaca cheese product was distributed to retails stores and delis in 10 pound balls, labeled with the name “Torres Hillsdale Country Cheese LLC.”

The recall was announced on April 22, 2009 and encompasses production dates 3/17/2009, with an expiration date of 5/20/2009.

No illnesses have been reported to date in connection with the recalled products. However, the incubation period for Listeria can be as long as 70 days. Rhode Island Listeria Recall: Sprouts

On April 10, 2009, the the Rhode Island Department of Health (HEALTH) issued a consumer advisory regarding sprout products that may be contaminated with Listeria monocytogenes. Distribution of these sprouts included Shaws, Stop & Shop, Whole Foods and IGA in Rhode Island. All sprouts being recalled have a sell-by date code from 03/21/09 through 04/27/09 and are in four ounce plastic containers, with the exception of the 8-ounce Nature’s Promise Organic Alfalfa and the five-pound bag of bulk alfalfa sprouts. There have been no cases of Listeria in Rhode Island in 2009. Anyone who bought an item on the recall list should throw away the product right away or return it to the place of purchase for a refund.

Sopressata Sausage Recall

DeNiro Cheese, a Youngstown, Ohio, firm, has recalled approximately one pound of Sopressata sausage products that may be contaminated with Listeria monocytogenes, the U.S. Department of Agriculture's Food Safety and Inspection Service announced today.

The following product is subject to recall:

12-ounce approximate weight packages of "Nostrano SOPRESSATA MILD SAUSAGE, PRODUCT OF CANADA." Each package bears a use-by date of "07/09/09" and a product code of "91009" as well as "CANADA 476A" inside the Canadian mark of inspection.

The sausage product was produced on October 9 and sent to one Italian specialty retailer in Boardman, Ohio. The name and location of the retail establishment is made available on the FSIS Web site, in accordance with the FSIS retail rule.

The problem was discovered through FSIS routine microbiological testing. FSIS has received no reports of illnesses associated with consumption of this product.

Consumption of food contaminated with Listeria monocytogenes can cause listeriosis, an uncommon but potentially fatal disease. Healthy people rarely contract listeriosis. However, listeriosis can cause high fever, severe headache, neck stiffness and nausea. Listeriosis can also cause miscarriages and stillbirths, as well as serious and sometimes fatal Listeria infections in those with weakened immune systems, such as infants, the elderly and persons with HIV infection or undergoing chemotherapy.

Listeria: Zeigler Hot Dog Recall

R. L. Zeigler Co., Inc., a Selma, Ala., firm, is recalling approximately 28,610 pounds of hot dog products that may be contaminated with Listeria monocytogenes, according to the U.S. Department of Agriculture's Food Safety and Inspection Service (FSIS).

The recalled Zeigler hot dog products were produced on Sept. 22, and were sent to food service institutions and retail establishments in Alabama, Florida, Georgia, Mississippi, and Tennessee. Therefore, if anyone from these states is diagnosed with listeriosis (Listeria infection) after consuming a hot dog, please contact our law firm.

The possible Listeria contamination was discovered by the Georgia State Department of Agriculture through microbiological testing. FSIS has received no reports of illnesses associated with consumption of this product.

Fishers Dairy Listeria Risk

Raw milk from Fisher’s Dairy in Portersville, Pennsylvania, may be contaminated with Listeria monocytogenes. In 2006, Fisher's Dairy gave up its raw milk permit, but state inspectors found that the dairy had begun selling raw milk again without a permit.

“During an investigation of the dairy, inspectors purchased raw milk which tested positive for Listeria monocytogenes," said Pennsylvania Department of Agriculture Secretary Dennis Wolff. "If consumers have raw milk from this farm, they should discard it immediately."

No illnesses have been reported as a result of the potential Listeria contamination, but if people who consumed the raw milk become ill, they should consult their physicians.

The Pennsylvania Department of Agriculture has detained all milk products at the farm. Samples were taken from the farm on March 6, and tested positive for Listeria monocytogenes on March 10.

Symptoms of a Listeria infection (listeriosis) are fever, muscle aches, and sometimes gastrointestinal symptoms such as nausea or diarrhea. If infection spreads to the nervous system, symptoms such as headache, stiff neck, confusion, loss of balance or convulsions can occur.

Infected pregnant women may experience only a mild, flu-like illness, but infections during pregnancy can lead to miscarriage or stillbirth. (Read about Listeria/listeriosis miscarriage.)

Symptoms of listeriosis can appear in four days to two months. To date, the Pennsylvania Department of Agriculture has not received any reports of illness related to the Fisher's Dairy Listeria risk.

Discover Cuisine Chicken Recall Due to Listeria - Illinois, Indiana, Michigan and Ohio

Meijer Distribution Center, a Michigan firm, has voluntarily recalled approximately 2,184 pounds of frozen chicken entrées that may be contaminated with Listeria monocytogenes, according to the USDA's Food Safety Inspection Service (FSIS).

The following product is subject to recall:
12-ounce packages of “Discover Cuisine ™ Red Curry Chicken & Jasmine Rice.” Each package bears the Canadian establishment number “Est. 302” inside the Canadian Food Inspection Agency mark of inspection as well as a “Best By” date of “12 18 08.”
The recalled frozen chicken entrées were produced on Oct. 18, 2007, and were sent to distributors and retail establishments in Illinois, Indiana, Michigan and Ohio.

The problem was discovered through FSIS microbiological sampling. FSIS has received no reports of illnesses associated with consumption of the recalled .

Consumption of food contaminated with Listeria monocytogenes can cause listeriosis, an uncommon but potentially fatal disease (Listeria/listeriosis wrongful death). Listeria Recall: J and B Meats Bratwurst

The Minnesota Department of Agriculture is warning consumers not to eat smoked pork and beef bratwurst make by J&B Meats of Barnesville, Minnesota, with the lot number PBB30306, and Minnesota State Establishment Number 1198. The recalled J&B Meats bratwurst may be contaminated with Listeria monocytogenes, a potentially-fatal foodborne pathogen. The contamination was found through routine testing.

J&B Meats sold the bratwurst at its retail store in Barnesville, about 20 miles southeast of Moorhead. J&B Meats is asking consumers to return any recalled bratwurst to the store. However, if someone has eaten any of the bratwurst, it should be kept in the freezer and labeled “Do not eat” for at least 70 days (Listeria incubation period) after the date it was consumed. If the person(s) who ate the recalled bratwurst are diagnosed with a Listeria infection (listeriosis), the recalled bratwurst may be evidence.

According to the Minnesota Department of Agriculture, there are no reports of illnesses from the product. The sausages are often sold frozen, meaning people who do not hear of this recall could eat the bratwurst months from now.
