Cargill Lawsuit
The Cargill lawsuit brought on behalf of a Minnesota woman who was paralyzed after eating Cargill hamburger contaminated with E. coli O157 has been settled for a confidential amount. The initial complaint had asked for $100,000,000.
Vons Ground Beef Recall Due to Salmonella

Vons supermarkets in California and Nevada are among the retail outlets that took delivery of ground beef subsequently recalled by Cargill's Beef Packers Inc. due to concern the meat may have caused an outbreak of Salmonella Newport in Colorado and other western states.
Vons is owned by Safeway Inc. and Safeway and Sam's Club stores also received ground beef made in Fresno and recalled by Cargill. The Cargill recall involves 825, 769 pounds of ground beef and is associated with an outbreak that has sickened at least 40 people with a drug-resistant strain of Salmonella Newport.
In connection with the recall, USDA's Food Safety and Inspection Service (FSIS) released a complete list of retail stores that are known to have received the potentially tainted Cargill beef and many Vons stores in California and Nevada are on the list.

Sams Club Recall Due to Salmonella Outbreak

Sam's Club stores in 10 western states today announced a recall of ground beef that came from Cargill's Beef Packers plant in Fresno, California. The Cargill plant recalled nearly 43 tons of ground beef products associated with an outbreak of Salmonella Newport in Colorado, California and other western states.
Sam's Club said 94 of its stores sold items involved in the Cargill recall. The stores are in Anchorage and Fairbanks, Alaska; Great Falls, Montana; and various locations in Arizona, California, Colorado, Idaho, Nevada, Utah, New Mexico and Wyoming.
Sam's Club said the items would have been purchased between June 16 and July 8. The six recalled items are:
- 90% GROUND BEEF COV MAX 10% FAT with a UPC of 0021209400000
- 90% GROUND BEEF COV MAX 10% FAT with a UPC of 0021200200000
- 90%GROUND BEEF PATTY MAX 10% FAT with a UPC of 0021200300000
- GROUND BEEF MAXIMUM 10% FAT with a UPC of 0029200200000
- MAXIMUM 10% FAT REDUCED PRICE PATTY with a UPC of 0029200300000
- 90% GROUND BEEF MAX 10% FAT/CASE ONLY with a UPC of 0021204700000

Safeway Recalls Ground Beef in Salmonella Outbreak

The potentially tainted meat was supplied to Safeway by the Fresno, California, plant of Beef Packers Inc., which is owned and operated by food giant Cargill. The USDA's Food Safety and Inspection Service (FSIS) announced earlier in the day that 825,769 pounds of Beef Packers ground beef was being recalled because it may be linked to the outbreak.
Meanwhile, the Colorado Department of Health and Environment reported that the majority of known illnesses in the Salmonella Newport outbreak have occurred in Colorado, where there have been 21 confirmed cases since late June and mid-July. Colorado officials said consumers should look out for ground beef stamped with establishment number EST 31913 if produced between early June and mid-July.
Colorado said it has epidemiological data showing that 15 of 16 confirmed illnesses were in people who said they purchased their ground beef at Safeway. The retailer said its recall affects stores in Colorado, Arizona, California, Hawaii, Nebraska, Nevada, New Mexico, South Dakota and Wyoming.
Fred Pritzker, president and founder of national food safety law firm Pritzker Olsen, is advising consumers to check their freezers for ground beef products that have been recalled by Cargill and Safeway. Pritzker also cautioned consumers that Salmonella Newport is resistant to antibiotics normally used to fight Salmonella infections. This increases the risk for hospitalization and for treatment failure.

Most healthy adults overcome Salmonellosis without medical treatment, but symptoms including diarrhea and severe stomach cramps can last up to seven days. Salmonella infections can be serious and even life-threatening in young children, the elderly and people who have weakened immune systems.

List of Recalled Cargill Ground Beef Products
We are providing a list of the recalled Cargill ground beef products as a public service. Consumers should look in their freezers for the recalled Cargill ground beef products and return them or discard them only if no one has eaten any of the ground beef. If someone has eaten some of the ground beef, save it for 10 days beyond the date on which any of it was last consumed. If no one becomes ill, discard it or return it. If someone who ate ground beef contracts an E. coli infection, the remaining ground beef may be used as evidence in a lawsuit against Cargill and other responsible parties.

Cargill Ground Beef Recall Points to Need for Federal Action
States impacted by the recall are: Connecticut, Maine, Maryland, Massachusetts, Michigan, New Jersey, New York, Ohio, Pennsylvania and Virginia. Residents of these states should look in their freezers for ground beef products that are on the list of recalled Cargill ground beef products.
The ground beef products involved in today's recall were produced between October 8 and 11, 2007, at the company's plant in Wyalusing, Pennsylvania. Cargill learned of the possibility of contamination after the USDA returned a confirmed positive on a sample of product produced Oct. 8, 2007. Today is November 3, 26 days after that contaminated sample was produced. This ground beef should have been recalled the day there was any evidence of possible contamination. If that date was before the ground beef was distributed, it should never have been distributed.
In addition to Cargill, other manufacturers of ground beef products and other products (Jeno's and Totino's pizza) have also dragged their feet regarding product recalls. The federal government needs to take action to 1) prevent contaminated ground beef from entering the food supply system and 2) immediately recall ground beef when there is any evidence of contamination. This will require legislation giving the USDA the authority to establish mandatory sanitation and processing guidelines for slaughter houses and meat processors and the authority to recall potentially-contaminated meat. We have contacted federal legislators regarding this and will continue to work for the elimination of E. coli in our country's food supply.
