Beyond No-Fault Insurance

According to no-fault laws in most states, insurance companies covering automobile accidents must provide for minimum coverage for loss arising out of the injury of any one person. The no-fault coverage usually includes minumum amounts for medical expenses, income loss, replacement services loss, survivor's economic loss and survivor's replacement services. In addition:

  • No-fault does not pay accident victims for pain and suffering
  • To get paid for pain and suffering, you must look to the at-fault driver's auto insurance company and sue, if necessary, to get fully and adequately compensated
  • No-fault is a minimum payment and does not cover expenses or losses beyond this amount unless your auto insurance policy provides for more (you paid an additional amount)
  • For expenses and losses that are not covered by no-fault insurance, you can sue the at-fault driver and possibly others

To get adequate compensation, families must recover amounts available under the at-fault driver's auto insurance policy and amounts available under the insurance policies of other responsible parties. Wrongful death claims involve specific laws that outline the procedures a family must go through to file the claims and recover on them.  In most states, a wrongful death trustee (or the equivalent) is appointed by the court.  This trustee acts on behalf of the family.

In most states, the wrongful death laws allow next of kin to recover on a wrongful death claim.  “Next of kin” as defined in most states includes a spouse, parents, children, grandparents, siblings, nieces, nephews, aunts and uncles.
