Interstate trucking companies are regulated by the Federal Motor Carrier Safety Administration (FMCSA). Some of the FMCSA regulations that can be used to determine negligence in a semi truck accident case include the following:

  2. Truck driver drug and alcohol use. FMCSA regulations require motor carriers to implement a successful controlled-substances-use-and-alcohol-misuse program.
  3. Driving requirements. The federal regulations prohibit a semi truck driver from driving when he or she is too tired, drunk, too sick, knows that the truck is not in good working order, etc.
  4. Truck driver qualifications. These regulations prohibit a trucking company from permitting an unqualified person to drive a semi truck.
  5. Safe semi truck brakes, tires and other parts and accessories. FMCSA has detailed requirements regarding parts and accessories necessary for safe operation of a semi trailer truck. If an accident is caused by defective brakes, for example, you may have claims against the trucking company, the company that maintained the truck, the manufacturer of the semi tractor and the manufacturer of the brakes.
