Do I have a case? Deciding what's best for you

Many factors are involved in deciding whether to make an injury claim. Here are some things to consider:

Fault
In order to make a claim for your injuries, the fault of the other party has to be greater than yours. If your fault is greater than fifty percent you are not allowed to recover for your losses. Any percentage of fault up to fifty percent (as determined by a jury) attributable to you reduces your recovery by that percentage.

Damages
That's the amount of money that compensates you for your injuries. In order to recover for car accident injuries in Minnesota, you have to meet one or more of the following "tort thresholds":

  • Permanent injury
  • Disfigurement
  • Continuous disability for sixty days or more
  • Medical expenses in excess of $4,000

Personal considerations
A personal injury claim takes time and requires some emotional involvement. Some people believe that it's better to simply move on with life. Others believe that a person who causes injury to another should be held responsible. Still others believe that a personal injury is a terrible loss for which they should receive full compensation.
