Personal Injury and Wrongful Death

Speeding Semi Truck Flips Over, Killing Mother and Child in Pickup Truck

Our attorneys have won lawsuits
against trucking companies.

A mother and her 2-year-old child were killed when the trailer portion of a semi-truck flipped over and crushed their pickup. The woman and her son were just sitting at the corner waiting to turn when the semi took the corner too fast, flipping the trailer onto the pickup truck. The 2004 Chevrolet pickup was completely crushed.

The semi truck, loaded with pineapples, was westbound failed to slow down sufficiently as it tried to enter the turnpike. It took emergency vehicles 45 minutes to get to the scene, due to the remote location. The victims died at the scene.

In an accident involving a speeding semi truck, we investigate to determine what other laws may have been broken by the semi driver. For example, whether the semi truck driver violated the hours of service regulation that is meant to prevent truck driver fatigue.

Who Can You Sue In the Event of a Semi Accident Death

Semi accident liability is complex and requires extensive investigation and analysis by the semi accident lawyer. Insurance coverage has to be researched. The liable parties may include:

  • The owner of the semi: When there is an accident involving a commercial truck or van, the owner of that truck or van (trucking company, waste management company, construction company, UPS, FedEx, etc.) is usually liable. Semi trucks generally have a cab and a trailer. In the event that one company owns the cab and another company owns the trailer, both may be liable.
  • The owner of the freight: Attributing liability to the owner of the freight involves excellent legal skills.
  • The driver of the semi: Although the driver of the truck may bear a significant amount of liability, they generally do not have any resources to pursue.
  • The employer of the driver: Employers are vicariously liable for accidents caused by employees while acting within the course and scope of their employment.
  • The parent company of the owner of the semi or employer of the driver (where applicable): Your truck accident lawyer will need to analyze corporate documents to determine any additional parties that may be held liable.
  • The manufacturer of the truck, cab, trailer or any truck part: If there is a defect in design or manufacturing of any part of the truck, tractor-trailer cab or trailer, they may be held liable. It could turn out to be that multiple manufacturers may be liable for injuries or death.
  • A third-party maintenance company: If a third-party maintenance company was responsible for maintenance of any part of the truck, cab or trailer, that company may be liable for injuries or death if it can be proven that inadequate maintenance contributed to the accident.
  • The driver and owner of another vehicle: When truck accidents involve multiple vehicles, it may be possible to sue for damages under the auto liability policies of the drivers and owners of the other vehicles involved.
  • The manufacturer of another vehicle: Any time a defective vehicle or part of a vehicle causes an accident or worsens the injuries, the manufacturer may be liable.
