Amtrak Accident Lawsuit
On June 24, 2011, a John Davis Trucking semi truck hit an Amtrak train in Churchill County, Nevada, about 60 miles east of Reno. At least 6 people died and several others were injured.
Evidence at the scene includes the following:
- There are no obstructions in visibility of the tracks at the railroad crossing, and the crossing should have been visible to the semi truck driver for over a mile.
- Signals were set by the railroad to activate about 25 seconds prior to the train entering the crossing. In that case, the signals would have been visible about a half mile back for a truck traveling the speed limit, which is 70 miles per hour.
Investigators are looking at possible causes of driver distraction and are awaiting the results of driver toxicology tests to see if the truck driver was drunk or at all under the influence of alcohol or drugs. They are also looking at the truck driver's records regarding the following:
- health and medical history
- training and experience
- past safety violations
Investigators are also looking at the trucks tires and brakes to determine if they were defective. If that is the case, the manufacturer of any defective part may be liable for the injuries and deaths caused by the accident.
The Motor Carrier Operations Team has been reviewing records of the company, John Davis Trucking Company, Inc., a Nevada trucking company. The company was involved in 19 random roadside inspections since September, 2010. Out of those, there were 7 violations. Those insepctions did not involve the accident vehicle.
The Amtrak California Zephyr was westbound from Chicago, Illinois, to Emeryville, California, when the accident happened. Our attorneys represent accident victims nationwide.
