Minnesota Wrongful Death Statute

Wrongful Death Lawyer MNIn Minnesota, wrongful death claims are governed by Minnesota Statutes, section 573.02.  According to the statute, “When death is caused by the wrongful act or omission of any person or corporation, the trustee appointed as provided in subdivision 3 [the trustee represents the surviving spouse and the next of kin] may maintain an action therefor if the decedent might have maintained an action, had the decedent lived, for an injury caused by the wrongful act or omission.”

In Minnesota wrongful death cases, a lawyer represents the trustee who is acting on behalf of the surviving spouse and next of kin.  The Minnesota wrongful death lawyer will need to prove the following to recovery compensation:

  1. The death of a human being
  2. Caused by the wrongful act or omission (negligence) of a person or corporation
  3. Financial loss (damages) suffered by the surviving spouse or next of kin as a result of the Minnesota wrongful death

Minnesota Wrongful Death Trustee

The person who brings a wrongful death lawsuit is called a "trustee." He or she is appointed by a judge to bring the wrongful death claim on behalf of the spouse and next of kin.  The wrongful death trustee is usually a family member.  A wrongful death trustee is not required for a dram shop claim, i.e., a claim against a business that sells liquor.

At the end of the Minnesota wrongful death case, the wrongful death trustee divides the proceeds among the spouse and next of kin.
