Defective Medical Devices, Malpractice and HIV-AIDS

Hepatitis C lawsuits generally involve one or both of the following:

  1. Product Liability. A defect in the design of a medical device that prevents the device from being adequately cleaned and sanitized
  2. Medical Malpractice. A situation where a hospital or clinic did not clean and sanitize invasive medical products adequately, used syringes or other products on more than one patient, did not clean up blood from the floor or other surfaces, used unstrerile gauze and/or saline, used the same gloves with different patients or used otherwise contaminated gloves, or was otherwise negligent.
