Personal Injury and Wrongful Death
Hepatitis B Exposure and Hepatitis B Lawsuit
Hepatitis B is caused by hepatitis B virus (HBV). HBV attacks the liver and can cause chronic infection, cirrhosis (scarring) of the liver, liver cancer, and liver failure. Hepatitis B can be fatal.
1. Hepatitis B can be transmitted by infected human tissue, including blood. The risk of transmission of hepatitis B during human tissue implantation and blood transfusions prompted the promulgation of Title 21 of the Code of Federal Regulations section 1270.21. This regulation specifically requires human tissue and blood donors to be screened for hepatitis B and donor specimens to be tested for the same.
2. Hepatitis B can be transmitted by a medical device that was not cleaned properly. Hepatitis B can be transmitted by any medical device that is at all invasive, including a biopsy device or a syringe. This is usually the result of unsanitary conditions or inadequate cleaning and sterilizing procedures.
3. Transmission of Hepatitis B is generally associated with the following high-risk groups:
- Persons with multiple sex partners or partners with a diagnosis of a sexually transmitted disease
- Men who have sex with men
- Sex contacts of infected persons
- Injection drug users
- Household contacts of chronically infected persons
