Guidant Defibrillator Lawsuit
PritzkerOlsen, P.A. Files Guidant Implantable Defibrillator Class Action Law Suit
On behalf of client C.L. and other similarly situated individuals, PritzkerOlsen, P.A. , filed suit against Guidant Corporation and its subsidiaries, Cardiac Pacemakers and Guidant Sales Corporation, alleging that certain of its implantable heart defibrillator devices are defective.
The Guidant defendants designed, manufactured and sold implantable defibrillators including the Ventak Prizm® 2 DR Model 1861, Ventak Prizm® DR Model 1851, Ventak Prizm® VR HE Model 1852, Ventak Prizm® DR HE Model 1853, Ventak Prizm® VR HE Model 1857, and Ventak Prizm® DR HE Model 1858.
According to the FDA, certain Ventak models have malfunctioned and are the subject of a recall: “The malfunction that is the subject of the recall causes damage to the device’s circuitry, potentially resulting in the inability to deliver the required shock during episodes of arrhythmia. This malfunction could lead to a serious, life-threatening event. Importantly, the device does not give any sign of impending failure, and there is no test that predicts whether any particular device will fail. At this time it is not possible to provide accurate estimates of the failure rate for these devices, but at least two deaths attributable to this failure mode have been reported.”
The plaintiff, C.L., was implanted with a Guidant Ventak Prizm™ implantable heart defibrillator in December 2001. She underwent surgery to have her Guidant Ventak Prizm™ implantable heart defibrillator removed and replaced with a defibrillator manufactured by another company on June 14, 2005. She and her husband are seeking damages against the Guidant defendants for injuries and damages they sustained including medical and hospital expenses as well as pain and suffering. They are also bringing claims on behalf of the class people—believed to be in the thousands – who had certain Guidant devices implanted in their bodies.
