Five Things You Need to Do if You Have (or Suspect You Have) a DePuy ASR™ XL Acetabular System Hip Implant
Step One – confirm that you received the DePuy ASR™ XL Acetabular System
This implant first became available in July 2003. If your implant was before then, this recall does not apply to you.
If you are not sure if your implant is the DePuy ASR™ XL Acetabular System, contact your doctor or the hospital at which it was implanted and ask whether it was the DePuy ASR™ XL Acetabular System.
Step Two – Contact your doctor
By now, you probably received a packet of information from your doctor and scheduled an appointment with him/her. If you have not already done so, you should schedule an appointment without further delay
Step Three – Schedule Tests recommended by your doctor
Your doctor has or will schedule tests to determine if your DePuy ASR™ XL Acetabular System has failed. These tests include regular X-Rays, blood tests, MRI or ultrasound. If recommended by your doctor, have the tests as soon as possible.
Step Four – What to do/say and what not to do/say to DePuy
DePuy wants you to call its “ASR Help Line.” They claim it’s because they’re going to reimburse you for reasonable out of pocket expenses and need information to process your claim. True or not, it is likely that DePuy also seeks information from you that may be used to defend the company against litigation by you or similarly situated individuals. Here is what we are recommending to our clients:
- Do not sign any DePuy document unless it is first reviewed by an attorney experienced in handling hip implant cases (many lawyers are advertising for these cases; make sure the lawyer with whom you consult has actual experience handling hip implant cases)
- Do not provide DePuy (or its claim handling company, Broadspire) with “blanket” medical authorizations. If you provide an authorization, make sure it is limited to only those providers that treated you for the implant and any problems you had thereafter. Further limit your authorization to only that treatment directly related to implantation of and subsequent care for the DePuy ASR™ XL Acetabular System.
- Do not discuss your care, treatment, problems or other issues with DePuy or anyone working or affiliated with DePuy.
Step Five – Discuss your options with an experienced attorney
Dealing with a failed or potentially failed hip implant is an important matter. If you’re having problems with your DePuy ASR™ XL Acetabular System, the decision to undergo explantation and revision surgery will be a life-changing experience and should not be undertaken lightly.
Few lawyers, including some advertising for these cases, have experience handling hip implant cases. That’s because they are complex, expensive and require working with a variety of experts. Even though DePuy is acknowledging a problem (which is too obvious to ignore), do not think that DePuy or its parent company, Johnson & Johnson, will simply agree that your problems were caused by its recalled DePuy ASR™ XL Acetabular System. More likely, DePuy will claim your problems are not serious, were not caused by the DePuy ASR™ XL Acetabular System, were the result of surgeon error or were caused by something you did or failed to do. Thus, the lawyer you choose needs to have experience with these issues and not be intimidated by a company with DePuy’s clout.
