Product Liability Lawsuit Information

A product liability lawsuit involves injury caused by a defective product. A defective product is one that is not reasonably safe for its intended use. An intended use of a product includes all those uses a reasonably prudent person might make of the product, bearing in mind its characteristics, warnings and labels.

Companies sued in product liability cases include the manufacturer of the defective product, the wholesaler or distributor of the product and often the retailer of the product. There are three kinds of product liability cases:

  • A design defect (the product was manufactured as intended but it was inherently unsafe),
  • A manufacturing defect (the design of the product was adequate but this particular product was not made correctly), and
  • A failure to warn or instruct (the instructions for and warnings about use of the product were inadequate).

In practical terms this means the manufacturer has a duty to "design out" dangers inherent in the product. If the defect cannot be designed out, the manufacturer has to guard against such hazards. If the danger cannot be designed out or guarded against, the manufacturer must warn and instruct users of dangers inherent in the product.

  • Save or retain the product and any documents or packaging that accompanied it.
  • Identify as much information about the product as possible including the name of the manufacturer, model name and number, place and date of purchase and serial number.
  • Store it in a safe place and do not modify or change it.
  • Obtain the name, address and telephone number of any witnesses.
  • Do not discuss the case with anyone and do not give any written or recorded statements about it.

Hylands Teething Tablets Lawsuit
On October 23, 2010, FDA notified consumers of a Hyland’s Teething Tablets recall issued because the tablets may cause belladonna toxicity.

GE Oven Recall - Attorney
GE®, GE Profile™, Monogram® and Kenmore® Wall Ovens were recalled in November of 2009 and Built-in Combination Wall and Microwave Ovens were recalled in December of 2007.

General Electric Stove Recall - Attorney
GE Monogram® Professional Gas Ranges were recalled in June 2007 and GE Profile™ Freestanding Dual Fuel Ranges were recalled in April of 2009.

Graco Stroller Wrongful Death Attorneys
On October 20, 2010, Graco Children's Products Inc., of Atlanta, Georgia, recalled about 2 million strollers that they quit selling in 2007. Baby Matters Nap Nanny Recall
On July 26, 2010, the U.S. Consumer Product Safety Commission (CPSC), in cooperation with Baby Matters LLC, of Berwyn, Pennsylvania, announced the voluntary recall of 30,000 Nap Nanny® portable baby recliners. CPSC is investigating a report of a 4-month-old girl from Royal Oak, Mich. who died in a Nap Nanny® that was being used in a crib.

Tots in Mind Playyard Tent Strangulation Death
Prompted by the death of a toddler, on July 15, 2010, the U.S. Consumer Product Safety Commission (CPSC) and Health Canada (HC), in cooperation with Tots in Mind Inc., of Salem, N.H., announced the voluntary recall of about 20,000 (and 85 in Canada) Cozy Indoor Outdoor Portable Playard Tents Plus Cabana Kits.

Sprout Stuff Ring Sling Baby Death
In June of 2010, Sprout Stuff, of Austin, Texas, recalled about 40 Sprout Stuff infant ring slings. CPSC and Sprout Stuff are aware of one report of a death of a 10-day-old boy in the recalled sling in Round Rock, Texas in 2007.

Evenflo Gate Lawsuit
On March 25, 2010, Evenflow Company of Miamisburg, Ohio, announced a recall of Evenflo Top-of-Stair™ Plus Wood Gates. The Evenflow gate recall involves about 150,000 in the United States and 33,000 in Canada. The slats on the gate can break or detach, posing a fall hazard to children.

Baby Bracelet Lead Poisoning
Allerds Design (doing business as Hidden Hollow Beads) recalled about 900 Allreds Design Baby Bracelets and Pacifier Clips on February 17, 2010, because the recalled Allerds Design bracelets and pacifier clip clasps contain high levels of lead.

Can-Am ATV Recall
BRP U.S. Inc. is recalling about 2,400 model year 2010 Can-Am® ATVs. The power steering in these vehicles can fail, resulting in a sudden loss of steering control to the driver.

Stork Craft Crib Recall and Fisher-Price Crib Recall
Prompted by the four deaths and falls, Stork Craft has announced a Stork Craft and Fisher-Price crib recall that involves about 147,000 Stork Craft drop-side cribs with the Fisher-Price logo and almost 2 million Stork Craft drop-side cribs that do not have the Fisher-Price logo on them. Fisher-Price and the the U.S. Consumer Product Safety Commission (CPSC) have received a report of one child falling out of a Fisher-Price 3-in-1 high chair. In response, Fisher-Price has voluntarily recalled about 24,000 Fisher-Price 3-in-1 high chairs.

SlyDog Retractable Dog Leash Recall
Worldwise Inc. has recalled about 223,000 SlyDog retractable dog leashes because the metal clasp can break, causing the leash to recoil back and injure the dog owner.

Deda Forza Bicycle Handlebar Stem Recall
Deda Elementi S.r.l., of Italy has recalled Deda Forza bicycle handlebar stems because they may crack and cause the rider to fall and suffer personal injury.

Wolf Gas Range Recall
Wolf Appliance Inc. has recalled about 24,000 Wolf Gas Ranges due to possible burn hazard.

Kawasaki ATV Recall
Kawasaki Motors Corp. has recalled about 6,000 2008 Model Year KFX 50 and KFX 90 Youth ATVs. The throttle can fail to return to the idle position when released or could fail to be at idle on start-up. Stanley Crib Recall
Stanley Furniture Company has recalled about 1,200 2nd Nature Built to Grow Cribs. The cribs could fail to meet a federal safety standard for crib dimensions. When the mattress support is in the middle setting, the space between the mattress and the crib could be too wide, posing an entrapment hazard to infants. Read about the Stanley crib recall.

KYMCO Mongoose Youth ATV Recall
KYMCO USA has recalled about 1,700 2008 Model Year Mongoose Youth ATVs. A manufacturing defect in the carburetor can cause the throttle to stick open, posing a risk of serious injury or death to the rider. Read about the KYMCO Mongoose ATV recall.

Arctic Cat ATV Recall

Jardine Crib Recall
Jardine Enterprises has recalled about 320,000 Jardine cribs. The wooden crib slats and spindles can break, creating a gap, which can pose an entrapment and strangulation hazard to infants. Read about the Jardine Crib recall.

Wal-Mart Charm Key Chain Recall
Wal-Mart has recalled certain key chains because the charms contain an excessive amount of lead. The Illinois Attorney General informed Wal-Mart and CPSC on April 16, 2008, that the key chain was found in the home of a 9-month-old child who was discovered to have high blood-levels of lead.
